# BeepLoop License 1.0

**End-User License Agreement**

BeepLoop is proprietary software. Its source code is not published, and
these terms govern your use of the program itself.

In one paragraph: **BeepLoop is free forever on Linux, for anything you
want, including making money with it.** Anything you make with it — plugins,
presets, projects, music — is entirely yours. You may not redistribute the
program, and Windows and macOS versions are sold and distributed by the
licensor alone.

Parts of the BeepLoop project *are* open source, under their own permissive
licenses — see [Open-source components](#open-source-components) below. This
license does not apply to them.

## Acceptance

In order to get any license under these terms, you must agree to them as both
strict obligations and conditions to all your licenses. You accept them by
installing or using the software.

## Linux Use Grant

You may **install and use the software on a Linux Platform, free of charge,
for any purpose, including commercial purposes**.

This grant covers, without limitation: making music, performing live,
recording, teaching, running a studio, selling what you create with the
software, and using the software inside a business. There is no seat limit, no
revenue threshold, and no separate license to buy.

**This grant is irrevocable for every version of the software that the licensor
has published.** The licensor may change these terms for future versions, but
cannot take away the free use, on a Linux Platform, of a version already
released. Releasing a version under these terms is a promise about that
version, and it is meant to be kept.

## Restricted Platform Terms

Use of the software on a **Restricted Platform** — Microsoft Windows and Apple
macOS — requires a separate commercial license from the licensor, obtained
through an official channel. Current pricing and availability are published on
the project website.

Only the licensor may build, publish, distribute or sell the software for a
Restricted Platform.

## Your Work Is Yours

This section exists so that an ecosystem can grow around BeepLoop without
being swallowed by it.

The following are **not** covered by this license, and the licensor claims no
rights in them whatsoever:

- **extensions** written against the BeepLoop Python plugin API, the MCP
  interface, or any other documented extension point;
- **`.bloop` project files**, instrument presets, samples, tunings, themes,
  scripts, catalogues, and any other data or content created with or for the
  software;
- **the music you make**, in any form;
- separate programs that merely communicate with the software through its
  documented interfaces.

You may **use, publish, give away or sell** any of these under **any terms you
choose**, including open-source terms, on **any platform, including Restricted
Platforms**. You need no permission and owe nothing.

## What You May Not Do

- **Redistribute the software.** You may not distribute, publish, sell, rent,
  lend, sublicense or otherwise make the software available to third parties,
  on any platform, whether free of charge or not — including app stores,
  package repositories, download pages, installers, disk images, containers and
  pre-installed systems.
- **Circumvent licensing.** You may not remove, disable or work around any
  licensing, activation or purchase mechanism, nor remove or alter copyright
  notices.
- **Reverse-engineer**, decompile or disassemble the software, **except** to
  the extent such acts are expressly permitted by applicable law that cannot be
  excluded by agreement — in particular the right to decompile for
  interoperability under Article 6 of Directive 2009/24/EC, and equivalent
  provisions elsewhere. Before relying on that right, please just ask: the
  interfaces are documented, and if something you need is missing the licensor
  would rather document it than have you guess.

If you would like BeepLoop packaged for your distribution, shipped on a
device, or rolled out across a team, ask. Separate written permission is
routine and usually granted.

## Trademarks

"BeepLoop", the BeepLoop name, logo, wordmark and application icon are
trademarks of the licensor and are **not** licensed by these terms. You may use
the name nominatively — to say truthfully that your extension is for
BeepLoop, or that your work is compatible with it.

## Open-Source Components

Several parts of the BeepLoop project are published as open source, under
their own licenses, and **this EULA does not apply to them**:

They are yours to use, fork, redistribute and build upon under those terms,
with no reference back to this license. In particular, the Python extension
API being Apache-2.0 means there is no doubt whatsoever about your right to
write, publish and sell extensions.

## Third-Party Software

The software incorporates and links against third-party components licensed
separately, under their own terms — including sfizz (BSD-2-Clause), the
Steinberg VST3 C API (MIT), GTK, libadwaita, GLib, json-glib, FluidSynth,
libsndfile and ALSA (LGPL), PipeWire (MIT), lilv and LV2 (ISC), and Python
(PSF). Nothing in this license restricts your rights in those components, and
nothing in this license grants you rights in them. See
[debian/copyright](debian/copyright) for the full inventory.

Where a third-party component is licensed under the LGPL, published builds link
it dynamically and ship it as a replaceable library, so that you may relink the
software against your own version of that component. That right is granted by
those components' own licenses and is not affected by these terms.

## No Other Rights

These terms do not allow you to sublicense or transfer any of your licenses to
anyone else, or prevent the licensor from granting licenses to anyone else.
These terms do not imply any other licenses.

## Violations

The first time you are notified in writing that you have violated any of these
terms, or done anything with the software not covered by your licenses, your
licenses can nonetheless continue if you come into full compliance with these
terms, and take practical steps to correct past violations, within 32 days of
receiving notice. Otherwise, all your licenses end immediately.

## Warranty and Liability

***As far as the law allows, the software comes as is, without any warranty or
condition, and the licensor will not be liable to you for any damages arising
out of these terms or the use or nature of the software, under any kind of
legal claim.***

**Consumers keep their statutory rights.** Nothing in this section limits any
warranty or remedy that applicable consumer-protection law grants you and that
cannot be excluded by agreement — including, in the European Union, the legal
guarantee of conformity. Nothing here excludes liability for death, personal
injury, gross negligence or wilful misconduct.

## Governing Law

These terms are governed by French law. If you are a consumer, this does not
deprive you of the protection of the mandatory rules of the law of your country
of habitual residence.

## Definitions

The **licensor** is Fabien Bernier, and the **software** is BeepLoop, the
software the licensor makes available under these terms, in any form the
licensor publishes it.

**You** refers to the individual or entity agreeing to these terms.

**Your licenses** are all the licenses granted to you for the software under
these terms.

**Linux Platform** means any operating system whose kernel is the Linux kernel,
including but not limited to Ubuntu, Debian, Fedora, Arch Linux and their
derivatives.

**Restricted Platform** means Microsoft Windows and Apple macOS, in any
version, and any environment whose primary purpose is to run the software on
one of them.

## Getting other terms

These terms are the default, not the only option. If you need something they do
not allow — packaging BeepLoop for your distribution, embedding it in a
product, a site licence for a school or a studio — ask. Commercial and custom
licenses are available.
